The Minnesota courts have created forms for individuals to use to divorce on their own without an attorney. Get the divorce forms online.
The forms are broken down into two general sections. The first section has the various forms needed for a divorce that includes children while the second section provides the forms for those going through a divorce without children. The process of a divorce with or without children varies so it is important to use the correct forms for one’s particular situation.
These forms can be used when both parties want a divorce and have a full and complete agreement on all the legal issues leaving no issues in dispute. This means the couple must make their divorce-related decisions ahead of time. Some of these are: legal custody, physical custody and parenting time for children, an equitable division of assets such as the home, retirement and debt, and a determination of finances moving forward.
Once the couple completes the forms, they sign divorce documents and file a joint divorce Petition and any other applicable forms with the court. The court responds with written confirmation of the case being filed with the court, which includes a case number. The divorcing couple then waits to receive the divorce Judgment and Decree, which is the legal document signed by a judge that makes their divorce final.
The forms can also be used by a spouse who wants to start the divorce even though none or some of the legal issues in their case are still unresolved. The divorce process at least begins with potential litigation or mediation in the future to bring the case to a resolution at some point in the future.
At least one spouse must have resided in Minnesota for at least 180 days before filing for divorce. Minnesota also is a no-fault divorce state which means the couple needs to give no reason for the divorce other than to say that their marriage has suffered an irretrievable breakdown and is unfixable.
